Terms of Use
Who you are contracting with
ScaffoldED360 is provided by ExcelUp Lab LLC ("ExcelUp Lab", "we", "us"), trading as ScaffoldED360. By creating an account or continuing to use the service you agree to these Terms of Use. If you use ScaffoldED360 on behalf of a school, district, or institution, you confirm you have authority to bind that organisation; otherwise you confirm you are of legal age to enter into this agreement. Questions: support@exceluplab.com.
Educator responsibility
ScaffoldED360 provides teacher-support recommendations. Generated content must be reviewed by a qualified educator. The application does not diagnose disabilities, determine eligibility for services, create legally binding accommodations, or replace decisions made by an IEP, Section 504, multilingual learner, intervention, or school-based team.
Acceptable use
- Upload only material you have the right to use.
- Do not upload personally identifiable student information.
- Review every generated resource before classroom use.
- Do not present generated supports, accommodation settings, reading-level targets, or the alignment QA checklist as a legally binding accommodation, eligibility, or IEP/504 decision.
- No unlawful use, fraud, spam, infringement of anyone's intellectual property, or interference with the security of the service (malware, probing, scraping, circumventing plan limits or technical controls).
- No generating hateful, harassing, sexually explicit, deceptive, or otherwise prohibited content, and no attempts to jailbreak or misuse the AI features.
- No reverse engineering, reselling, or redistributing the service, and keep your account credentials confidential — you are responsible for activity under your account.
- The 14-day Pro trial is limited to one per customer. Creating additional accounts or email addresses to repeat the trial, or to repeat trial-purchase-refund cycles, is a breach of these terms.
AI-generated content
ScaffoldED360 uses AI to draft scaffolded materials. You are responsible for the content you upload and the prompts you enter, for holding the rights to that content, and for verifying every output before classroom use. Outputs may be inaccurate or incomplete and are not a substitute for professional, clinical, or legal judgement. You keep ownership of your uploads and of the generated materials you review and adopt; we may remove content, filter outputs, or suspend accounts that breach these terms, and rights-holders may email support@exceluplab.com to request a takedown. Repeat infringement ends access.
Intellectual property and licence
ExcelUp Lab LLC retains all ownership of ScaffoldED360, including its software, documentation, and branding. Your plan grants a limited, non-exclusive, non-transferable right to use the service. You grant us a limited licence to host and process your content solely to provide the service.
Payments, subscriptions, and refunds
Payments are processed by Stripe on behalf of ExcelUp Lab LLC, the seller of record for all orders. Card details are collected and stored by Stripe; we never see or store card numbers. Billing, renewal, cancellation, and refund mechanics are described in this agreement and in our Refund Policy. Subscriptions renew automatically until cancelled; see our Refund Policy for our 30-day money-back guarantee.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data for a reasonable period before it is deleted.
Warranties, liability, and governing law
ScaffoldED360 is in active development. Features may change, and some capabilities are labeled as unavailable while they are being built. We do not guarantee uninterrupted or error-free performance and, to the fullest extent permitted by law, disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we exclude indirect or consequential losses (including lost profits, data, or goodwill); nothing limits liability for fraud, death, or personal injury where the law forbids it. You indemnify us against claims arising from your content or your misuse of the service. These terms are governed by the laws of the State of Delaware, USA, and disputes are subject to the courts located there.
